HERO STUDIO HIRE TERMS AND CONDITIONS

These Terms and Conditions apply to all photography, video, content production and other approved hires of Hero Studio. By accepting a proposal, paying a deposit or invoice, or commencing use of the Studio, the Hirer agrees to these Terms and Conditions.

1. Definitions

Booking means the Studio hire and any equipment, furniture, backdrops, services, consumables or other items confirmed in the applicable proposal, quotation or invoice.

Bond means the refundable security bond payable in connection with a Booking.

Hire Period means the confirmed booking period and includes all access, bump in, unloading, setup, production, pack down, cleaning, reset and loading out.

Hirer, You and Your means the person or entity making the Booking and includes, where the context permits, its employees, contractors, crew, talent, clients, invitees and guests.

House Rules means any reasonable operational, safety or housekeeping rules communicated by us or displayed at the Premises.

Premises means Hero Studio at 428A Parramatta Road, Petersham NSW 2049.

Studio means those areas of the Premises expressly included in the Booking.

Studio Zone means an individually bookable area of the Studio.

We, Us and Our means the operator of Hero Studio.

2. Booking and Acceptance

A Booking is confirmed only when the required deposit or payment has been received and the Booking has been accepted by us.

Unless otherwise stated in the applicable proposal or invoice, a 50% deposit is required to secure a Booking.

Bookings are non transferable without our prior written approval.

The Hirer must ensure that the intended use of the Studio, anticipated number of attendees and any material production requirements are disclosed before the Booking is confirmed.

We may decline a booking request prior to acceptance.

The Hirer is responsible for ensuring that all persons attending under its Booking comply with these Terms and the House Rules.

3. Hire Period and Overtime

The Hire Period includes all access, bump in, unloading, setup, rehearsals, production, breaks, pack down, cleaning, reset and loading out.

The Studio must be completely vacated and returned to the required condition by the end of the Hire Period.

Additional time is subject to availability and is not guaranteed.

Where the Hirer or any person associated with the Booking remains in or continues using the Studio beyond the Hire Period, additional time will be charged at the applicable additional hourly rate in 30 minute increments, or as otherwise specified in the applicable proposal or invoice.

Additional time may be deducted from the Bond where it has not otherwise been paid.

4. Booked Areas, Shared Use and Restricted Areas

The Hirer may use only the Studio Zones, furniture, equipment and facilities expressly included in the Booking.

The Hirer and its attendees must remain reasonably within the parameters of the booked area and must not occupy, use, relocate or interfere with another Studio Zone without permission.

Unless Whole Studio hire has been expressly confirmed, other Studio Zones may be hired to or occupied by other clients at the same time. Reasonable movement, activity and sound transfer between areas may therefore occur.

Even where Whole Studio hire has been booked, the adjacent private office, storage areas and any other areas identified as private or restricted remain excluded from the Booking. Studio staff may access communal facilities and restricted operational areas where reasonably required.

Unauthorised entry into or use of any unbooked, private or restricted area constitutes a breach of these Terms and may result in additional charges or termination of the Booking.

5. Sound Recording

The Studio is not soundproofed.

A low level of traffic and environmental noise from Parramatta Road and surrounding areas may occasionally be audible. Where separate Studio Zones are occupied simultaneously, some sound transfer between zones may also occur.

The Hirer is responsible for determining whether the Studio is suitable for its audio requirements and for providing appropriate microphones, sound treatment, recording practices and post production audio processing.

Where critical dialogue, silence or a high degree of audio isolation is required, Whole Studio hire is strongly recommended. Whole Studio hire reduces internal activity but does not constitute a guarantee of silence or sound isolation.

We do not warrant that the Premises will be free from traffic, building, environmental or other external noise.

6. Dry Hire, Furniture and Equipment

Unless expressly included in the Booking, standard Photo Studio dry hire does not include lighting equipment, light stands, backdrops, production equipment, additional furniture, crew, technical support or consumables.

Furniture, rugs, styling pieces and equipment may change from time to time. Photographs displayed on our website, proposals, social media or marketing material are indicative only and may not represent the exact items available on the Booking date.

If a particular item is essential to a production, the Hirer must confirm its availability with us before the Booking.

Furniture and equipment allocated to another zone or not included in the Booking must not be used without our prior permission. Where additional furniture, equipment, backdrops or other chargeable items are used without permission, the applicable hire or usage charge may be invoiced or deducted from the Bond.

Where at least 48 hours notice is required to prepare, clear, furnish or configure a set or Studio Zone, we cannot guarantee that requests made after that time can be accommodated.

7. Furniture and Equipment Handling

Furniture must not be dragged across Studio floors.

Where an item cannot be safely moved by one person without risk of injury or damage, it must be moved by two or more people or using an appropriate dolly, trolley or wheeled equipment. Suitable moving equipment may be requested from the Hero Studio team.

Particular care must be taken when moving wheeled furniture, stands or equipment near windows, walls, sets and other furnishings.

Equipment should be loaded and unloaded through the designated loading area wherever reasonably practicable.

Vehicles must not remain parked in the loading area after loading or unloading is complete.

The Hirer is responsible for loss of or damage to Studio equipment, furniture or other property used during the Booking, excluding reasonable wear and tear.

8. Backdrops, Consumables and Restoration Charges

Backdrops and consumables are not included in dry hire unless expressly stated in the Booking.

Where a seamless paper backdrop is requested, a $50 plus GST backdrop hire and setup fee applies unless otherwise quoted.

Any section of seamless paper that is marked, creased, torn, contaminated, walked on or otherwise rendered unsuitable for future photographic use will be charged at $30 plus GST per linear metre, measured and rounded up to the nearest usable half metre.

The Hirer must notify us before leaving the Studio if any paper backdrop has been damaged or requires trimming.

Use of the Studio’s white vinyl backdrop or roll is charged at $100 plus GST per Booking, unless otherwise quoted. The vinyl must be wiped clean following use. Footwear, equipment or activities likely to puncture, permanently mark or damage the vinyl must not be used on it. Damage requiring trimming, repair or replacement will be charged in addition to the usage fee at the reasonable cost of rectification or replacement.

Where walls, plinths, flats, sets or other painted Studio surfaces require repainting as a result of the Booking, a minimum repainting charge of $50 plus GST applies. Additional labour and materials may be charged where more extensive preparation, repair or repainting is required.

These charges are minimum or standard charges and do not limit the Hirer’s liability where the reasonable cost of restoring or replacing an item exceeds the stated amount.

9. Floors, Walls and Surfaces

Nothing may be painted, drilled, screwed, nailed, glued or otherwise attached to Studio surfaces without our prior approval.

Please do not apply gaffer tape directly to Studio floors. Removing adhesive tape can lift paint and damage the floor finish. If floor marking is required, the Hirer must speak with the Hero Studio team before applying any tape.

The Hirer is responsible for any resulting repair, repainting, cleaning or reinstatement costs.

10. Cleaning, Reset and Waste

The Studio must be returned in substantially the same condition and configuration in which it was provided.

The Hirer should photograph its booked area at the commencement of the Hire Period to record its initial condition and assist with returning furniture and other items to their original positions.

Failure to take photographs does not transfer responsibility for damage to us and may limit the Hirer’s ability to establish the pre existing condition of an item in the event of a dispute.

All equipment, furniture and other Studio property must be returned to its original location unless otherwise directed.

Small amounts of ordinary rubbish may be placed in the bins provided. Excessive rubbish, production waste, packaging, props, food waste and other material generated by the Booking must be removed from the Premises by the Hirer.

The refrigerator must be cleared of all items brought onto the Premises before departure.

Glassware, crockery and cutlery used during the Booking must be washed, dried and returned to their proper location.

Air conditioning units must be switched off at the end of the Booking.

Additional cleaning, waste removal, repairs or reinstatement required beyond an ordinary Studio reset may be charged to the Hirer.

A $200 plus GST professional cleaning charge applies where Studio carpet or rugs are soiled, stained or left in a condition reasonably requiring professional cleaning. Where specialist treatment, repair or replacement costs exceed $200, the additional reasonable cost may also be charged.

11. Food and Drink

Food and beverages other than water must not be consumed on or immediately adjacent to sets, rugs or fabric furniture, including the Mod Lounge, Chesterfield furniture and other upholstered seating.

The Hirer is responsible for staining, spills or other damage caused by food or beverages.

12. Security Bond

A refundable Security Bond is required for Studio hires unless waived by us in writing.

Unless otherwise specified in the Booking:

$500 applies to a single Studio Zone Booking; and

$1,000 applies to multiple Studio Zones or Whole Studio hire.

We may require a higher Bond where we reasonably consider the Booking to present an increased risk due to factors including attendee numbers, proposed activities, equipment, catering, set construction or the nature of the production. Any increased Bond will be disclosed before the Booking is confirmed.

The Bond may be applied to reasonable costs arising from the Booking, including damage, loss, missing items, unauthorised equipment or furniture use, consumables, backdrop usage, additional cleaning, waste removal, overtime, restoration, repainting, breach of these Terms, unauthorised access or other outstanding charges.

Following inspection, any undisputed balance of the Bond will ordinarily be returned within five Business Days.

Where further investigation, cleaning, repair quotations or replacement pricing is reasonably required, we may retain the relevant portion of the Bond until the cost has been established.

The Bond does not limit the Hirer’s liability. Amounts exceeding the Bond remain payable by the Hirer and may be invoiced separately.

13. Insurance

The Hirer must maintain public liability insurance of not less than $10 million for the Booking and provide a current Certificate of Currency before access to the Studio is granted.

The Hirer is responsible for ensuring that any contractors or production suppliers requiring their own insurance maintain appropriate cover.

14. Electrical Equipment and Safety

Electrical and production equipment brought onto the Premises must be safe, properly maintained and suitable for its intended use.

Where testing and tagging is required by applicable law, regulation, workplace requirement or Australian Standard, the Hirer is responsible for ensuring compliance.

Cables, stands, booms and other equipment must be installed and secured so as not to create an unreasonable risk to attendees, Studio staff, property or other Studio users.

We may require unsafe equipment or practices to cease immediately.

15. Accessibility and Facilities

The Studio is not wheelchair accessible.

There are approximately 20 steps from the front entrance and approximately 12 steps from the rear entrance. Once inside, the main Studio floor is generally level.

Persons who have difficulty using stairs should contact us before their Booking. Rear access may be available on request and involves fewer stairs, but all access to the Studio requires the use of stairs.

Persons choosing to use the stairs are responsible for assessing their own ability to do so safely.

The Premises has one bathroom containing a toilet and basin. Hirers organising larger productions should plan accordingly.

Kitchenette and refrigerator access may be available as part of or on request with a Booking.

16. Conduct, Nuisance and Compliance

The Hirer is responsible for the behaviour and supervision of every person attending under its Booking.

Attendees must behave safely and respectfully towards Studio staff, other Studio users, neighbours and property.

Harassment, intimidation, abusive behaviour, discrimination, dangerous conduct, unlawful activity and unreasonable nuisance are not permitted.

Noise must be maintained at a reasonable level appropriate to the Premises and surrounding occupants.

We may give reasonable directions relating to safety, noise, access, equipment, protection of property or operation of the Studio. The Hirer must ensure those directions are followed promptly.

We may immediately suspend or terminate a Booking where conduct is unsafe, unlawful, abusive, materially disruptive, causes unreasonable nuisance, risks damage to property, interferes materially with another Studio user, or where the Hirer commits a serious or repeated breach of these Terms.

Where termination results from the Hirer’s breach, no refund is payable for unused Hire Period, subject always to rights that cannot lawfully be excluded.

17. Cancellation

Unless alternative cancellation terms are stated in the applicable proposal:

Cancellation more than 2 Business Days before the Hire Period attracts a cancellation fee equal to 25% of the hire fee.

Cancellation within 2 Business Days attracts a cancellation fee equal to 35% of the hire fee.

Cancellation within 1 Business Day attracts a cancellation fee equal to 50% of the hire fee.

Where we are able to replace a cancelled Booking, we may reduce or waive the applicable cancellation fee at our discretion.

Cancellation charges apply to the hire fee and any non recoverable costs or specially ordered items incurred for the Booking. The refundable Bond will otherwise be returned.

Failure to attend without cancellation is treated as cancellation within 1 Business Day and does not create an automatic entitlement to reschedule.

18. Personal Property

All property brought onto the Premises remains at the Hirer’s risk.

The Hirer is responsible for securing cameras, computers, production equipment, props, wardrobe, personal belongings and hired equipment.

To the extent permitted by law, we are not responsible for loss, theft or damage to property brought onto or left at the Premises except to the extent caused by our negligence or other liability that cannot lawfully be excluded.

19. Damage and Hirer Responsibility

The Hirer is responsible for loss, damage, additional cleaning and reasonable reinstatement costs caused by the Hirer or persons attending under its Booking, excluding fair wear and tear.

The Hirer must notify us promptly of any breakage, spill, mark, equipment fault, backdrop damage or other incident occurring during the Booking.

The Hirer must not attempt repairs without our approval.

Where professional repair, specialist cleaning or replacement is reasonably required, the Hirer is responsible for the reasonable cost incurred.

20. Liability and Indemnity

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.

To the maximum extent permitted by law, we are not liable for indirect, consequential or special loss arising from the Booking, including loss of production time, loss of footage, loss of profit, loss of opportunity or costs associated with reshooting, except to the extent such liability cannot lawfully be excluded.

The Hirer indemnifies us against claims, losses, liabilities, damage and reasonable costs arising from the acts or omissions of the Hirer or persons attending under its Booking, including injury to persons or damage to property, except to the extent caused or contributed to by our negligence, breach of contract, wilful misconduct or other liability that cannot lawfully be excluded.

21. Events Outside Our Reasonable Control

We are not responsible for delay or inability to provide the Studio arising from circumstances outside our reasonable control, including power or utility failure, building emergencies, severe weather, fire, flood, government action or other events that make the Premises unsafe or unavailable.

Where we cancel a Booking because the Studio cannot reasonably be provided, the Hirer may elect to receive a refund of amounts paid for the affected Studio hire or reschedule to another mutually agreed available date.

We are not responsible for the Hirer’s consequential production costs arising from such cancellation to the extent permitted by law.

22. Recovery of Amounts Owing

Amounts properly payable under these Terms may be deducted from the Bond or invoiced separately.

Where reasonable costs exceed the Bond, the Hirer must pay the outstanding amount within seven days of invoice unless otherwise stated.

We may recover overdue amounts and reasonable recovery costs to the extent permitted by law.

23. Disputes

If a dispute arises, the parties will first attempt to resolve it through good faith negotiation.

If the dispute cannot be resolved within 14 days, either party may propose mediation before commencing court proceedings, except where urgent interlocutory relief or debt recovery proceedings are reasonably required.

Nothing in this section restricts any right or remedy available under applicable consumer law.

24. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

The parties submit to the jurisdiction of the courts of New South Wales and courts entitled to hear appeals from them.

25. Entire Booking Agreement

The Booking consists of these Terms together with the applicable accepted proposal, quotation or invoice and any written variations agreed by us.

Where a proposal, quotation or invoice expressly specifies a particular rate, Hire Period, Studio Zone, inclusion, Bond or other commercial term, that specific term applies to that Booking.

These Terms otherwise apply to all Studio hires.
